Terms and Conditions

Yorkshire Section Event & Meets Terms & Conditions 1st January 2020

When your committee organises events on behalf of the members, they often have to sign binding contracts with commercial companies and pay substantial non-returnable deposits. Because of the need to protect the Club’s finances and also member’s rights, we now find it necessary to introduce our own formal terms and conditions relating to all event bookings. The following terms and conditions shall apply to all pre-bookable events organised from 1st January 2020 onwards.

  1. All events organised by the Yorkshire Section of the BMW Club (The BMW Club Ltd) shall be booked or attended by members of any Section of The Club under the following terms and conditions.

  2. RIDING WITH US. All participants in events must be on road legal taxed and insured motorcycles with valid MOTs where appropriate. Participants who ride with us must obey local regulations and rules of the road and speed limits etc and drive safely within the limits of their own abilities. Participants will be responsible for their riding at all times including when riding in Club group rides.

  3. ELIGIBILITY TO ATTEND. All Club members and associates are eligible to attend all or any of the Club's officially organised events. Club members may from time to time invite non-member guests to attend with them. Guests who decide they'd like to attend regularly should then join the Club paying the appropriate membership fee.

  4. EVENT BOOKINGS. Those who wish to book events should do so in writing to the organiser of the event (Email / Letter). Those that book should give their full details, names, address, email address, contact telephone number(s), and membership number. Reservation takes place when the deposit funds paid reach the Yorkshire Section bank account. Confirmation of the reservation will be made in writing (Email / letter). Requests for payment of the balance due will be made in writing (Email / letter). Final bookings will only be confirmed once payment of the balance due reaches the Yorkshire Section BMW Club account.

  5. BOOKING FORMS. Where appropriate the organisers will take bookings via a specific event booking form. Members booking will be required to sign that they understand and accept these terms and conditions and where appropriate or suitable or desired, that they’ve taken out suitable insurance cover. Details of those insurances and their expiry date(s) may be required to be given on the form.

    The organisers may also request that you provide details of a person (or persons) to contact, e.g. next of kin in the case of unforeseen events. The club and the event organisers will not accept any responsibility beyond contacting nominated individuals in the event of an unforeseen event. It is sensible that members have appropriate insurance cover to meet their medical care and any repatriation costs (both human and motorcycle).see item 8 below.

  6. CANCELLATIONS. In the event that the organisers find they have to cancel an event payments made directly to the club may be refunded. However, we will offer no refund or compensation if the cancellation is out of our control, such as war, riot, civil unrest, terrorism, natural disaster, industrial disputes or adverse weather conditions.

  7. THIRD PARTY COSTS. If we cancel an event for a genuine reason and a member has incurred any third party costs of their own (such as, but not limited to, ferry charges or other hotel bookings) we will not be liable. We strongly advise that members take out travel insurance to cover such costs. We strongly advise that members should not book ‘non-cancellable’ travel and hotel bookings.

  8. MEMBER CANCELLATIONS. If member(s) find they need to cancel a booking for any reason, a refund will only be granted if the reservation can be cancelled with a full (or part) refund from the venue. Such refund limited to the amount recovered less our expenses. We will also refund less our expenses if we can subsequently fill that now vacant place at the event.

  9. UNFORSEEN INCIDENTS. The BMW Club will not be liable under any circumstances for costs as a result of breakdown, accident. vehicle recovery or illness whilst attending our events. All Club Members should hold suitable medical, motorcycle and recovery insurance.

  10. EVENT ADVERTISING & DESCRIPTIONS. The organisers of events do so to the best of their ability. However details in advertisements and descriptions are only illustrative and not legal documents. Every effort is made to give accurate advice about events but we will not be liable for any inaccuracies or shortcomings that may become evident.
